It's the elitist thinking people in Government thinking they are in control of what people think, say, or do. The hard part about rooting these elitists out of our Government is that they are the financiers of bigger Government also. It's a constant battle between individual liberty and totalitarianism.

The guy might have a better argument without the letter from the state engineer. At least then he could argue that he was unaware of any requirements. The fact that he got the letter suggests that he new there was a potential issue and was trying to get around the law.

The EPA does not designate wetlands. It reviews certain actions of other federal agencies in accordance with the National Environmental Policy Act (NEPA) – which was passed by both houses of congress and signed by President Nixon. It is ultimately answerable to the President's Council on Environmental Quality.

Letters are not permit(s) regardless of what anyone says. Permits require stamps and signatures. This I know because I work for a government agency and everyday I make determinations of environmental compliance on proposed projects by electric, gas, telecommunication, water, wastewater, and other companies and industries.

Wetland issues are federal – they are subject to federal laws – and they can only be permitted by a federal agency or an entity operating under the authority of a Programmatic Agreement with some federal agency.

What he should have done was have the pond managed under state authority (different then a simple permit). The EPA then would have its scavenger tail tuck between its legs instead of picking on the helpless.

The EPA is a beaurocratic crock of sh!t, not only do they interefere and bully they also neglect their real job, do you know there are hundreds of chemicals in everyday use that have never been tested for toxity, cancer rate are climbing and it could well be through some of these chemicals which they just haven't bothered to get around to testing.

Here is where a Wyoming family legally got permits and went through all the motions to do things right and the EPA just trounces in without any legality or restraints and virtually attempts to bankrupt this common person.
